TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using Roaring Rage Room's website, booking platform, or on-site facilities (collectively, the “Services”), you (“you,” “your,” or “Guest”) agree to be bound by these Terms of Service (“Terms”). If you do not accept all Terms, do not use the Services.

2. Eligibility

• You must be at least 18 years old (or 8 with a parent/guardian present) to participate.

• You must present valid government-issued photo ID at check-in, photo IDs allowed.

• We may refuse entry to anyone who appears impaired, disruptive, or physically unable to participate safely.

3. Account & Booking

• Online bookings require accurate contact information and a valid payment method.

• Your reservation is confirmed only after full payment or the deposit listed during checkout.

• You are responsible for ensuring all participants in your party review these Terms before arrival.

4. Pricing, Payment & Taxes

• All prices are listed in U.S. dollars and may change without notice until paid.

• We accept major credit cards and any other methods displayed at checkout.

• Prices are exclusive of applicable sales tax unless stated otherwise.

5. Cancellations & Refunds

• Individual sessions: Cancel or reschedule at least 24 hours in advance for a full refund.

• Party packages/private events: Deposit is non-refundable; balance is refundable if canceled 7 days before the event.

• No-shows or late arrivals (15 minutes past start time) forfeit payment.

6. Safety & Conduct

• All Guests must:

  • Sign our digital liability waiver each visit.

  • Wear the required protective gear and closed-toe shoes.

  • Follow staff instructions at all times.

• No food, drink, gum, running, horseplay, or pretend fighting inside activity areas.

• We reserve the right to remove any Guest, without refund, for dangerous or disruptive behavior or for violating house rules posted on-site.

7. Assumption of Risk & Liability Release

Participation involves inherent risks, including but not limited to flying debris, physical exertion, equipment malfunction, or collisions with other Guests. By using the Services you acknowledge these risks and voluntarily waive, release, and discharge Roaring Rage LLC, its owners, employees, and affiliates from any and all claims, liabilities, damages, or expenses arising from injury, loss, or property damage incurred while on our premises, except to the extent caused by our gross negligence or willful misconduct.

8. Intellectual Property

All logos, trademarks, photos, videos, text, and other content displayed on the website or inside the facility are the property of Roaring Rage LLC or its licensors. You may not copy, modify, distribute, or exploit any content without prior written consent.

9. User-Generated Content & Media Release

If you upload, tag, or otherwise share photos, videos, or reviews related to the Services, you grant Roaring Rage LLC a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute that content for marketing or promotional purposes in any media. You may revoke permission for future use by emailing contact@roaringrage.com, but previously produced materials may remain in circulation.

10. Surveillance & Recording

For safety and security, common areas (excluding restrooms and changing areas) are monitored by CCTV. Footage may be reviewed in the event of an incident and shared with law enforcement if required by law.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.” Roaring Rage LLC disclaims all express or implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by Texas law, Roaring Rage LLC’s total liability to you for any claim arising out of or relating to the Services will not exceed the amount you paid us for the specific session or event giving rise to the claim. In no event will we be liable for indirect, special, incidental, punitive, or consequential damages.

13. Indemnification

You agree to defend, indemnify, and hold harmless Roaring Rage LLC, its affiliates, and their respective owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your negligent or wrongful acts.

14. Termination

We may suspend or terminate your access to the Services at any time for violation of these Terms or applicable laws, without refund.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Texas without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located in El Paso County, Texas, and you consent to personal jurisdiction therein.

16. Changes to Terms

We may update these Terms periodically. Material changes will be posted on our website with the “Last updated” date revised. Continued use of the Services after changes constitutes acceptance of the new Terms.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
